The Department of Transportation is rolling out a secure, online database that will give employers and other authorized users real-time information about commercial driver’s license (CDL) and commercial learner’s permit (CLP) holders’ drug and alcohol program violations. The FMCSA, or Federal Motor Carrier Safety Administration, Clearinghouse will contain records of violations of drug and alcohol prohibitions in 49 CFR Part 382, Subpart B, including positive drug or alcohol test results and test refusals. When a driver completes the return-to-duty (RTD) process and follow-up testing plan, this information will also be recorded in the Clearinghouse. Beginning January 6, 2020, Justifacts can assist employers in completing this required search for all applicants and existing employees. The FMSCA Clearinghouse includes:
- Reports of drug and alcohol violations. This will include alcohol test results with a concentration of .04 or greater, refusals to take an alcohol or drug test, as well as actual knowledge of a violation.
- Negative return-to-duty (RTD) test results and the successful completion of a driver’s follow-up testing plan.
Effective January 6, 2020, employers are required to query the Clearinghouse on all prospective covered employees and all current covered employees at least annually. All queries require driver consent.
Please note, until January 6, 2023, employers must conduct both electronic queries in the Clearinghouse and manual, offline inquiries to previous employers for pre-employment driver investigations.
